SuperMemo Mobile End User Licence Agreement

The Agreement is concluded between SuperMemo World sp. z o.o. and the user of the application (hereinafter referred to as ‘User’). The User must accept this Agreement in order to download and install the SuperMemo Mobile application (hereinafter also referred to as ‘Application’). Should the User not accept the terms and conditions of this Agreement, any downloading, installing or using the Application should be discontinued.

SuperMemo World sp. z o.o. hereby grants the User a personal free-of-charge licence to use the SuperMemo Mobile application. The use is defined as downloading the application to the random access memory (RAM) of a palmtop (PDA) or installing it to a non-volatile memory (Flash memory cards). The free-of-charge licence to use the Application covers no other uses, including but not limited to company, business or commercial use by legal entities or persons running a business activity within its scope of operation.

1. The installation of the Application shall be at the User’s own risk and account.
2. The User may install and use the Application on one palmtop. For personal use, the User is may make a backup copy of the Application.
3. The User may not distribute or make the Application available for copying. The User and third parties who are granted rights with regard to the Application must not modify, disassemble or copy the Application or any part thereof. The User may not copy the tracks, data or texts in the Application or any part thereof. The User may not create derivative works based on the Application or any content thereof.
4. Property rights to the Application or SuperMemo World sp. z o.o. trademarks, or any other rights not originating expressly under this Licence Agreement are not granted to the User.
5. The Application and SuperMemo trademarks are the property of SuperMemo World sp. z o.o. and are protected by Polish and international law.
6. No warranty is made to the User with respect to the SuperMemo Mobile software. SuperMemo World sp. z o.o. does not warrant that the Application and the documentation or installation software thereof are free from errors that would disable the correct installation of the Application.
7. To the greatest extent permitted by respective Polish law, SuperMemo World sp. z o.o. shall be in no event liable for any damages (including without limitation damages arising from operational loss, interruption, loss of data or pecuniary loss) that may arise from the use of, or inability to use, the software.
8. SuperMemo World sp. z o.o. makes no warranties that the functions of the Application satisfy the User’s requirements or expectations. The entire risk arising out of the use of the Application remains with the User.
